GIAN Course - Dignity Rights Clinic

The course will examine the concept of Dignity, both as a value and as a fundamental right in the Constitution of India. The preamble to the Constitution assures that the dignity of the individual will be respected. Dignity appears in the preamble along with other values of the constitution such as equality, liberty and fraternity along with social political and economic justice. The Indian Supreme Court has developed a significant body of caselaw interpreting the Art. 21 right to life as the right to live with dignity. The course will explore the impact of dignity on these other values and the influence of these other values on dignity.

Dignity along with equality, liberty and other values are abstract in conception and are invoked in different jurisdictions of the world. The principles and application of these principles has varied in different jurisdictions allowing the concept of dignity to evolve in multiple ways. This course will examine how the concept has evolved in India and reflect upon the different ways in which the concept has evolved in other jurisdictions with the understanding that the evolution of law has benefitted from an exchange of ideas, concepts and principles.
